Terms and Conditions
When you purchase the SmallBiz Theme or the Experts Training Membership, you are granted non-exclusive limited license to use the themes or products sold through our websites http://www.expand2web.com or http://www.smallbiztheme.com by Expand2Web LLC (the "products") in accordance with these Terms & Conditions (the "license") issued by our company.
Theme Licensing & Usage
Single-Site License
This license authorizes you to use the SmallBiz Theme for one website that you host or control.
The Single-Site License grants the ability to create one website for yourself or a client using the theme, however it does not grant the ability to “resell” or “redistribute” the theme itself or make it available to others directly.
Multi-Site License
This license authorizes you to use the SmallBiz Theme for up to 100 installs.
We will support the Multi-Site License purchaser via our normal email channels, but not the purchaser's clients.
The Multi-Site License grants the ability to create a total of 100 installs for yourself or clients using the theme, however it does not grant the ability to “resell” or “redistribute” the theme itself or make it available to others directly.
Per-Install / Per-Seat License
This license authorizes you to use the SmallBiz Theme for as many installs as you wish. The cost Per-Install will be specified in the Agreement that comes with your unique “Per Install SmallBiz Theme Version”
We will support the “Per-Install License” purchaser via our normal email channels, but not the purchaser's clients. The License or any individual Install is non refundable.
The Per-Install License grants the ability to create websites for yourself or clients using the theme, however it does not grant the ability to “resell” or “redistribute” the theme itself or make it available to others directly.
Reselling the SmallBiz Theme
If you would like to resell the SmallBiz Theme please join our Affiliate Program. Any other form of reselling or re-distributing of the SmallBiz Theme is a violation of the Terms of Use.
Updates
Theme updates are available to customers who have purchased our theme. Our themes are designed to be compatible with the latest available version of WordPress, but we can give no guarantee that older theme versions will run with future versions of WordPress. We are committed to doing our best to make all the themes compatible with future releases of WordPress as quickly as possible.
Support
Expand2Web offers these themes and designs 'as is', with no implied meaning that they will function exactly as you wish or with all 3rd party components and plugins.
We offer email support for general theme usage questions to our customers. Support is limited to the stock as-is theme. We do not support problems resulting from end-user customized files, code and/or added css. The Smallbiz does support child-themes however, technical support is limited to the parent theme. We do provide a Theme User Guide for customers as well.
Our hard working support team consists of WordPress experts and theme developers, and officially provides email support for SmallBiz Theme related questions within 24 hours.
In the case of Multi-Site Licenses, we will support the purchaser, but not the purchaser’s clients.
Theme compatibility
It is our duty to keep the themes up-to-date and working with the latest version of WordPress. Our themes are developed and fine-tuned for WordPress 3.0 or higher. Any version prior to that may have problems with some theme functionality. The minimal requirement for our themes is the same as WordPress, which is currently PHP 5.2 and MySQL 5.0 (requirements).
Plugin compatibility
There are thousands of WordPress Plugins available. We do our best to work with WordPress Plugins, but cannot guarantee compatibility with all plugins because they can be contributed by anyone, and can contain any code. Expand2Web is not responsible for WordPress issues and problems due to plugins or any other 3rd party add-ons.
Browser compatibility
Our themes support all modern web browsers including (but not limited to) Firefox, Safari, Chrome (all on PC & Mac) & Internet Explorer 7, 8 & 9. While we strive to give every theme a seamless & near-identical experience across each of these browsers, it is impossible to compensate for the lack of web standards support (relating to HTML & CSS) in some of these browsers.
In the case of a browser not support certain web standards, we will include a generic workaround for that browser, which will degrade a specific function / feature gradually and in a way that doesn't affect the user experience negatively.
Theme Refund Policy
We offer a 30 day money back guarantee - all we ask is that you show us you have uninstalled our theme.
Classroom - Experts Training Membership Refund Policy
We stand behind our training and membership program, and will refund your money if you are not satisfied. After the first month, we will prorate your membership based on the plan you are on:
Monthly - Silver Plan: You may cancel at any time. There is no minimum commitment. If you cancel in the first month, we will refund your first month's subscription. After that, just cancel and we will stop your subscription immediately. You must remain a member for 3 months to keep the SmallBiz Theme Multi-Site license.
Yearly - Gold Plan: We will refund the entire amount of your yearly plan within the first month of signup. After that, we will prorate on a monthly basis. You must remain a member for 3 months to keep the SmallBiz Theme Multi-Site license.
Lifetime - Platinum Plan: We will refund the entire amount of your lifetime plan within the first month of signup. After that, we will prorate on a monthly basis up to the end of the first year. You must remain a member for 3 months to keep the SmallBiz Theme Multi-Site license.
Price Changes
Expand2Web LLC reserves the right to modify prices of our themes at any time. Such notice may be provided at any time by posting the changes to the Expand2Web or SmallBizTheme.com website.
Warranty
Expand2Web does not warranty or guarantee these templates in any manner. We cannot guarantee they will function with all 3rd party components, plugins or web browsers. Browser compatibility should be tested against the demonstration templates on the demo server. Please ensure that the browsers you use will work with the templates as we can not guarantee that Expand2Web templates will work with all browser combinations.
Delivery
After we have successfully received your payment, your Theme information will be emailed to the email address you provided during the purchase process. This may take up to 1 hour but usually happens within minutes. If you do not receive an email after this time period, contact us through our website.
Ownership
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of Expand2Web. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
Site Content
All content, including imagery, published on the Expand2Web.com domain or the SmallBizTheme.com domain, including site content published on the showcase, is property of Expand2Web LLC and under copyright. Any replicated site content must be authorized and clearly referenced back to the source. Content from the Expand2Web or SmallBizTheme.com web site shall not be used or exploited for any commercial and non-private purposes without the prior written consent of Expand2Web.
